Acceptance of these terms
By using this website or any Gavorix application (together, the "Services"), you agree to these Terms of Use. If you do not agree, do not use the Services. Where an application is downloaded from an app store, the store's own terms also apply to the download and billing.
The Services
The Services are provided for your own use. We may change, suspend or discontinue any part of the Services at any time. Features, limits and prices are described in each application and may change. We give notice of material changes to paid features before they take effect.
Purchases
Paid features are billed through the app store your device uses. Payment, renewal, cancellation and refunds are handled by that store under its terms. We never receive your card details.
Subscription prices are charged by that store, and a change to the price of a subscription you already hold is handled under the store's own rules. Those rules require the store to tell you in advance and, depending on the size of the increase and where you live, either to ask you to agree to it or to give you the chance to cancel before it applies.
Acceptable use
You agree not to misuse the Services, including attempting to disrupt them, to access them by automated means at abusive volume, to reverse engineer them except where the law permits it despite this clause, or to use them in violation of applicable law.
Important: routing and results
Our applications may generate suggestions such as an ordering of stops. Suggestions are produced by software, may be inaccurate or unsuitable for your situation, and are not a substitute for your own judgment. You remain solely responsible for how you drive, where you go, compliance with traffic law, and the suitability of any route for your vehicle. Roads, closures and conditions change; verify before relying.
Disclaimer of warranties
The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free or that results will meet your requirements.
Limitation of liability
To the maximum extent permitted by law, Gavorix and its publisher shall not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Services. To the same extent, our total aggregate liability for all claims relating to the Services shall not exceed the greater of the amount you paid us for the Services in the twelve months before the claim arose or fifty US dollars.
Some jurisdictions do not allow certain exclusions or limits; where the law does not permit an exclusion or limit, it applies to the fullest extent permitted. Nothing in these terms excludes liability that cannot be excluded by law.
Dispute resolution: talk to us first
Before starting any legal proceeding against us, you must first raise the issue with us and give us a chance to fix it. Send a written description of the problem and what you want to support@gavorix.com. We will do the same before any claim against you. If the issue is not resolved within sixty days of that notice, either side may proceed as set out below. A proceeding started without this notice should be stayed or dismissed until the notice period has run.
Arbitration on an individual basis. Any dispute that is not resolved informally shall be finally resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis only. You and we each waive any right to a jury trial and to participate in a class, collective or representative action. Either side may instead bring an individual claim in small-claims court, and either side may seek injunctive relief for misuse of intellectual property in court.
You may opt out of this arbitration clause within thirty days of first accepting these terms by emailing support@gavorix.com with the subject "Arbitration opt-out".
Governing law
These terms are a contract between you and TSGI Services LLC, 30 N Gould St Ste R, Sheridan, Wyoming 82801. Mailing address: 11816 Inwood Road #1193, Dallas, Texas 75244.
These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, except where the law of your place of residence grants you protections that cannot be waived.
Changes to these terms
If we change these terms we will update the effective date at the top and, for significant changes, tell you in the Services before they take effect. Continued use after a change takes effect is acceptance of the changed terms.
Severability
If any provision of these terms is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect.
